CHENNAI: The Madras High Court ruled that a person acquitted from a case on benefit of doubt or discharged from a case can well be considered as disqualified for selection to the police service and that it cannot be termed as illegal or unjustified.
A full bench, comprising Chief Justice A P Shah and justices F M Ibrahim Kalifullah and V Ramasubramanian, gave the ruling while dismissing a batch of seven petitions from Manikandan and others.
The petitioners had challenged a government order denying appointment on the basis of their involvement and conviction in a crime or non-disclosure of the same in the application or during the selection process.
In some cases, the petitioners were acquitted from the charges, giving them the benefit of doubt, the bench said.
The bench said the person's failure to disclose in the application form either his involvement in a criminal case or pendency of the case would entitle the appointing authority to reject his application on the ground of concealment of a material fact, irrespective of the outcome of the criminal case.
